1. About TruePass
TruePass (“we,” “us,” or “TruePass”) operates TruePass.app, a seller-verification platform that allows dealers to generate time-limited, one-time trust codes that buyers can verify before completing a transaction. TruePass is operated by Biel Watches LLC.
2. What TruePass Does — and Does Not — Do
TruePass confirms:
- That a dealer holds an active TruePass account in good standing.
- That the trust code entered was generated by that dealer's account within the preceding minutes.
- Where identity verification has been completed, that the account holder's government-issued ID name was matched to their Stripe billing information at the time of verification.
TruePass does NOT:
- Guarantee the authenticity, condition, or value of any goods or services exchanged.
- Guarantee delivery or fulfillment of any transaction.
- Verify that a dealer's social media accounts or payment handles have not changed since verification.
- Act as an escrow, mediator, or party to any transaction.
- Provide fraud insurance or indemnification of any kind.
A green TruePass verification reduces your risk. It does not eliminate it. You are responsible for exercising your own judgment before sending any payment.
3. Limitation of Liability
To the fullest extent permitted by applicable law, TruePass and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of money, goods, data, or profits — arising from or related to your use of the platform or any transaction facilitated through it, even if TruePass has been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the greater of (a) the amount you paid TruePass in the twelve months preceding the claim, or (b) $100 USD.
4. Dealer Responsibilities
Dealers agree to:
- Provide accurate and truthful information in their profile and during identity verification.
- Only generate trust codes for transactions they are actively engaged in.
- Promptly update their payment handles if they change.
- Not share their login credentials or permit unauthorized use of their account.
- Not use TruePass to facilitate fraud, misrepresentation, or the sale of counterfeit goods.
Dealers found to be using TruePass to facilitate fraudulent transactions will be permanently banned and may be reported to law enforcement.
5. Deal Room Safety Check
The Deal Room safety check is an informational comparison tool that checks whether contact details, payment information, and trust codes you provide match data a dealer previously registered with TruePass. The safety check:
- Does not constitute advice, endorsement, or recommendation to complete any transaction.
- Does not verify the accuracy, truthfulness, or current validity of data a dealer registered — only that a match or mismatch exists at the time of the check.
- Does not guarantee that a dealer's registered information has not been compromised, transferred, or become outdated.
- Does not replace your own independent due diligence, including verifying the seller's identity, reputation, and legitimacy through other means.
A “match” or “All Clear” result means only that the data you entered matched what is on file. It is not a guarantee of safety, legitimacy, or successful outcome. A “mismatch” result means the data did not match, but TruePass cannot confirm whether fraud has occurred.
By using the Deal Room safety check, you expressly acknowledge and agree that: (a) you assume all risk associated with any transaction; (b) TruePass bears no responsibility for any loss, damage, or claim arising from your reliance on any verification result; (c) you waive any and all claims against TruePass, Biel Watches LLC, and their affiliates relating to transactions with any dealer, regardless of the verification outcome displayed.
6. Buyer Responsibilities
Buyers agree to:
- Use TruePass verification as one layer of due diligence, not the sole basis for a transaction decision.
- Verify the payment handle shown on TruePass matches the handle the seller provides.
- Not misuse the verification system to lock out legitimate dealers through repeated false attempts.
7. Identity Verification
Identity verification is powered by Stripe Identity. By initiating identity verification, you agree to Stripe's Privacy Policy and consent to Stripe processing your biometric data for identity verification purposes. TruePass does not store your ID photo, selfie, or raw biometric data. We store only the outcome (verified / not verified) and the verified name for cross-checking purposes.
8. Account Suspension and Termination
TruePass reserves the right to suspend or permanently ban any account, at our sole discretion, for violations of these Terms, fraud, abuse, chargebacks, or any activity that undermines the integrity of the platform. Subscription fees are non-refundable after the trial period.
9. Modifications to Terms
We may update these Terms from time to time. Continued use of TruePass after changes are posted constitutes your acceptance of the updated Terms. Material changes will be communicated via email or in-app notification.
10. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, or in the state and federal courts located in Florida.
